Doral, Abril 12, 2023 (Redacción Doral First Magazine). Una muy interesante sesión del Concejo de Doral se espera para hoy 12 de Abril ya que la agenda muestra en su primera parte una discusión sobre los conceptos iniciales de la firma de abogados contratada por la ciudad para estudiar la legitimidad del plan de retiro adoptado por la administración de Juan Carlos Bermúdez y sus aliados políticos en el Concejo, mediante la ordenanza 2021-02 en enero del 2021.
Básicamente la firma de abogados representada por Glen E. Thomas, emite un concepto en el que manifiesta que a pesar del cumplimiento de algunos de los requisitos necesarios para procesar la ordenanza, ciertas “provisiones del plan violan leyes y/o regulaciones estatales y/o federales en lo que se refiere a los planes de retiro en entidades públicas”.
“Una entidad gubernamental responsable de cualquier sistema de retiro o pensión sostenido total o parcialmente con fondos públicos no debe, después de enero 1 de 1977, proveer incrementos en los beneficios de los miembros favorecidos con tal sistema, a menos que dicha unidad realice las provisiones necesarias para tal incremento, basadas en fondos suficientes para cubrir los costos totales de los aumentos”.
Con esta provisión el gobierno busca proteger a los contribuyentes para que en el futuro no terminen pagando los costos de aumentos pensionales con sus impuestos.
“De acuerdo con mi investigación los requisitos constitucionales de la sección 14 articulo X y la parte VII del capítulo 112 no fueron observados durante la adopción del Plan de Retiro para oficiales electos y varios de los requisitos aplicables a la administración y provisión de fondos del Plan no se siguieron desde el comienzo”.
“Ninguno de los requisitos de pre-adopción fueron seguidos por la ciudad, no se hizo una revisión de cuentas para saber cómo se iban a pagar las pensiones y no se emitió un informe sobre el impacto de dichos pagos”. “Esto es importante no solo porque no se siguió la ley, sino porque indica que la ciudad adoptó el Plan sin poseer conocimiento de lo que los beneficios le costarían a los contribuyentes o cómo se iban a pagar dichos beneficios” “La División de Retiros de Florida confirmó que la ciudad no remitió los documentos relacionados con el Plan de Retiro para Doral”.
“El plan aparentemente seria pagado con el método “pay-as-you-go” – (Pague sobre la marcha – es decir sin previsión)”
El abogado recomienda remitir los documentos necesarios a la División de Retiros, algo que esperamos que la ciudad no haga, puesto que eso sería equivalente a legitimar el infame sistema pensional. También recomienda contratar los servicios de una firma legal que evalúe los costos e impacto del Plan y realice los estudios sobre provisión de fondos.
Sin embargo, el Concejo de la ciudad tiene la potestad de declarar el Plan ‘inconstitucional’ y detener su aplicación de manera inmediata para proteger los intereses de los contribuyentes. Lo anterior obligaría a quienes hayan recibido beneficios basados en dicho Plan, a reintegrarlos de manera inmediata.
PAGOS RETROACTIVOS
El análisis también concluye que, basados en jurisprudencia de la Fiscalía General de Florida, “Una ciudad no debe gastar fondos públicos para pagar a exempleados que estén bajo planes de retiro cuando esto no ha sido autorizado por la ciudad al momento del retiro del oficial o empleado”.
Lo más llamativo de este adefesio jurídico es que la ordenanza fue firmada por el abogado de la ciudad en ese momento, Luis Figueredo y por otro abogado, el alcalde de la ciudad Juan Carlos Bermúdez. Dos juristas que en su afán de pasar el Plan, cabalgaron sobre la ilegalidad con el voto de los concejales a excepción de Claudia Mariaca.
